Terms of Use

The terms for using the Data Maturity Solutions website, client accounts and Candidates accounts, including the free Digital Maturity Check.

On this page

1. About These Terms

These terms apply when you use the Data Maturity Solutions (DMS) website, a client account or a Candidates account. By creating an account or using the website, you agree to them. If you use a client account for your organisation, you confirm that you can accept these terms on its behalf.

A paid engagement, including a Digital Maturity Assessment, is covered by its own written agreement. Where that agreement and these terms differ, the agreement applies.

Our Privacy Policy explains how we handle personal information.

Read the Privacy Policy

2. Your Account

  • Give accurate details and keep them up to date.
  • Keep your password private and do not let anyone else use your account.
  • Tell us promptly if you think someone else has used your account.
  • You are responsible for what is done through your account.

3. Maturity Check and Assessment Results

The Digital Maturity Check is free. Its results come only from your own answers, which we do not check against evidence. They show a likely stage to guide a conversation and are not a formal rating, audit or certification.

Findings and reports from a Digital Maturity Assessment reflect the scope, evidence and interviews agreed for that assessment, at the time it was carried out. They do not guarantee the state of your systems, data, security or compliance.

Recommendations, including indicative costs and timeframes, are estimates. You decide whether and how to act on them. Our results do not replace legal, financial, security or other professional advice.

You may share your results and approved reports within your organisation. Please do not present them as an independent certification or as DMS endorsing a product, supplier or decision.

4. Candidates

Creating a Candidates account does not apply for a role. A profile or application does not guarantee work, an interview or a place on a shortlist.

The information you give us, including your CV, work rights, clearance and experience, must be true and complete. We may check it, including with the referees you name. Only name a referee who has agreed to be contacted by DMS.

5. What You Upload

You keep ownership of the answers, documents and other content you provide. You allow DMS to store, copy and use it to provide the services you asked for and as described in our Privacy Policy.

Only upload content you are entitled to share. Leave out other people's personal information unless the service needs it and you are allowed to share it. We may refuse or remove a file that does not meet our file rules or these terms.

6. Acceptable Use

When using the website or an account, do not:

  • break the law or infringe anyone's rights
  • try to reach an account, record or file that is not yours
  • test, bypass or interfere with our security, spam checks or rate limits
  • upload malware or files designed to cause harm
  • create accounts or submit forms by automated means
  • impersonate another person or misrepresent your organisation
  • submit content that is false, misleading, defamatory or offensive

We may suspend or close an account that breaks these terms or puts the services or other people at risk.

Deleted records are removed from normal use immediately. Restricted copies and stored files are retained for 30 days from deletion before scheduled permanent removal, as explained in our Privacy Policy. Closing an account may require a retention review before its records are deleted.

7. Our Content

The website, the DMS maturity framework, questionnaires, report templates and related material belong to DMS or the people who license them to us. You may view and print them for your own use. Do not copy, sell or republish them, or use them to provide a competing service, without our written permission.

8. Availability and Changes

We provide the website and free services as they are. We may change, suspend or stop any part of them, and we do not promise uninterrupted access.

You can close a Candidates account in account settings, or contact us to close a client account.

Links to other websites are for convenience. We are not responsible for their content.

9. Liability

Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

To the extent the law allows, DMS is not liable for indirect or consequential loss, or for loss arising from decisions made on the basis of a free check, self-rated results or general information on the website.

Where the law allows our liability for failing to meet a consumer guarantee to be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

10. Changes to These Terms

We may update these terms. The version and effective date at the top of this page show which terms apply. If you keep using the website or your account after an update, the updated terms apply.

11. Governing Law

These terms are governed by the laws of the Australian Capital Territory.
